Woolls Peer Dollinger & Scher prevailed in an insurance coverage action after the losing plaintiff appealed to the California Court of Appeal, Second Appellate District. The client’s policy contained an endorsement entitled “Limitation of Coverage – Real Estate and Property Management Operations” stating that it provided excess coverage in certain situations. The trial court granted summary judgment in the client’s favor, and the appellate court, in an unpublished decision, agreed that nothing was owed.
Katy Nelson prevailed on summary judgment in a federal court case filed in pro se by a homeowner who claimed his entire home sustained wind and water damage after a rainstorm. The suit sought damages for breach of contract, bad faith and unfair business practices. The court agreed that the first party policy’s one-year contractual limitation deadline barred the lawsuit.
